Article 1: General provisions 

The e-commerce website of The Diamond Frequency - Ondernemersatelier, a cvba with registered office in Genk, VAT BE 0876 478 43, RPR Tongeren, (hereinafter "The Diamond Frequency") offers its customers the opportunity to purchase the products from its online store online.

These General Terms and Conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through The Diamond Frequency's online store, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by The Diamond Frequency.

Article 2: Price

All prices stated are expressed in USD, always including VAT and all other duties or taxes to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes only and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind The Diamond Frequency. As for the accuracy and completeness of the offered information, The Diamond Frequency is only held to a means obligation. Under no circumstances shall The Diamond Frequency be liable in case of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance.

The offer is always valid while supplies last and may be modified or withdrawn by The Diamond Frequency at any time. The Diamond Frequency cannot be held liable for the unavailability of any product. If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

In the webshop, choose the desired products and click on "add to cart" to place them in your shopping cart.
After you have placed all desired products in the shopping basket, you can view the complete overview by clicking on the "view shopping basket" button or by clicking on the shopping basket at the top right of the page.
Once you have checked the shopping basket, you can proceed with the ordering process by clicking on the "Proceed to Checkout" button.
You will now be taken to the checkout page.
On this page you will be asked to enter your address and delivery address (for delivery). The shipping costs will be calculated after you have entered your address.

You will see another overview of your order. After you have entered all details correctly, choose the desired payment method.

The Customer has the choice between the following payment methods

  • By credit or debit card
  • via Paypal

Finally, you will be asked to agree to our terms and conditions.
If you have completed the above steps, you can finalize the order by clicking the "Place Order" button.
If you have selected Credit Card / Debit Card, you will be redirected to a secure environment to complete the payment process. If you selected PayPal, you will be deafened to PayPal to complete the payment process.
The order confirmation will be sent to you by email.

The Diamond Frequency is entitled to refuse an order pursuant to a serious default by the Customer in relation to orders involving the Customer.

Article 5: Delivery and execution of the agreement

Order processing
Once an order is received, it is processed in our system.
For print-on-demand products: Products are printed based on the specifications chosen by the customer.
For digital products: A download link is automatically generated and sent to the customer via email upon completion of the order.

Shipping
For print-on-demand products: Once printed, the products are carefully packaged and shipped to the delivery address provided by the customer.
For digital products: The download link will be sent directly to the customer via email.

Shipping times
Shipping times vary depending on the type of product:
For print-on-demand products: Production and shipping can take up to a few business days, depending on printing and specific products. Each item has a link to the shipping info with details of shipping times.
For digital products: The download link will be sent to the customer immediately upon completion of the order.

Print-on-demand items ordered through this online store are delivered in all countries except Guadeloupe, North Korea, Russia and Ukraine.

Delivery is made by the courier service chosen by our manufacturer.

Unless otherwise agreed or expressly stated, the goods are delivered to the Customer's residence within 30 days of receipt of the order. On the product page is a link where you can consult the delivery times.

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to The Diamond Frequency without delay within 7 days.

Risk for loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) takes physical possession of the goods.

Article 6: Retention of title

The delivered articles remain the exclusive property of The Diamond Frequency until complete payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of The Diamond Frequency's retention of title, e.g. to anyone who would come to seize items not yet paid for in full.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from The Diamond Frequency in their capacity as consumers.

The Customer cannot exercise the right of withdrawal for:

The delivery of print-on-demand products, these products are unique and are produced only when ordered. This also means that returns and exchanges are not possible if you ordered the wrong size or color or simply changed your mind.
The delivery of digital content that is not delivered on a tangible medium, if the performance has started with the express prior consent of the Customer and provided that the Customer has acknowledged that he thereby loses his right of withdrawal (e.g. download pdf, online course, ...);

In the case of a damaged product or manufacturing defect, we offer a free replacement or refund if you contact us within 7 days of delivery.

Article 8: Warranty

Pursuant to the Act of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact The Diamond Frequency's customer service department and return the item at their expense to the address then provided by The Diamond Frequency.

Upon detection of a defect, the Customer must inform The Diamond Frequency as soon as possible. In any case, any defect must be reported by the Client within a period of 7 days after delivery. Thereafter, any right to repair or replacement expires.

The warranty (commercial and/or legal) is never applicable to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 7 days following the date of purchase, if any, delivery, shall be deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 9: Customer service

Customer service at The Diamond Frequency can be reached via email at info@thediamondfrequency.com or via our contact form. Any complaints can be directed to this, and please include a clear photo showing the problem.

In the case of a damaged product or manufacturing defect, we offer a free replacement or refund if you contact us within 7 days of delivery of the product. Please contact our team using the contact form and include a clear photo showing the problem.

In case of a failed delivery, you can choose a replacement at extra cost or a partial refund.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to The Diamond Frequency, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without formal notice, to pay interest of 10% per annum on the unpaid amount from the date of default. In addition, the Customer shall be liable, ipso jure and without formal notice, to pay liquidated damages of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, The Diamond Frequency reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy

The controller, The Diamond Frequency respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data.

The personal data communicated by you will only be used for the following purposes:

  • The execution of the concluded agreement
  • The processing of the order
  • Sending newsletters, advertising and/or marketing purposes.

You have a legal right to access and possibly correct your personal data. Provided proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge by sending a written, dated and signed request to The Diamond Frequency, info@thediamondfrequenyc.com. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. To do so, you can always contact The Diamond Frequency, info@thediamondfrequency.com.

We treat your data as confidential information and will not transfer, rent or sell it to third parties.

It is possible that the personal data obtained will be passed on to companies cooperating with us: the manufacturers of the print-on-demand items and our provider of this service.

Customers are responsible for keeping their login information and password confidential. Your password is stored encrypted, thus The Diamond Frequency has no access to your password.

The Diamond Frequency keeps online (anonymous) visitor statistics to see which pages of the Internet site are visited and to what extent.

Article 12: Use of cookies

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by The Diamond Frequency to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - disputes

Belgian law applies, with the exception of the provisions of international private law on applicable law.

The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
